I would venture to say that most people who resort to spending their hard-earned cash on pixelated items are RL law-abiding people. A suspension of account would probably humiliate them enough that they'd stop for good.
The seller should be permanently banned.

I dunno if I agree with you...if you look at the motives of the seller/buyer, and the purpose of the A.Net's bannings...
the seller gets money, real world cash. This is outside the game, and really doesn't affect anyone within the game, or the competition within the game.
the buyer spends real world money (again, outside of the game), but is buying something not everyone else in the game can buy (personal wealth etc), therefore creating an unfair advantage in the game. This says to me that the buyer is at more of a fault.

While on the other hand I have sent in a complaint against someone for an obvious and well documented issue and not only was nothing done about it, the matter was in my opinion haphazardly handled on their end.
The whole deal just makes me want to play a game that has an actual admin/controller that you can contact. Like Battlefield 2 for example or playing a game with friends like Dungeon Siege 2 to just get away from lamers all together.

they need to ban the buyer AND the seller, i wish they would also go after ebay, they are letting people do something that is clearly against the contract you agree to when you sign up for the game, its like selling illegal merchandise basically, and they are letting it happen...

I truely feel sorry for you, and I hope you get unbanned. I think they should ban the seller(s), and warn the Buyers. I don't think its because of that, you got banned for. Maybe someone faked a log, or sent a SS that was photoshoped?
Anyway, I hope you get what you lost in return. You can always make a new account, and ask your guildmates to help you out just like you help them out. Good luck.

But cops just dont pull people off the street and make them disappear. Usually you are subjected to due process, given the chance to defend yourself, sentenced, then have the whole deal released to the public as an example to deter others.
Just blankly removing someone does absolutely no good for anyone because it serves no example as what not to do and if trouble makers care to test the system they will suffer the consquences.
Yes, I am totally for going after the sellers. In my opinion these people are no better than those who sell burned copies of games.

It's impossible to subject everyone to some process by which you can explain yourself etc. Maybe if we all pay $50 a month to play...in the meantime, don't do what they say not to!
I'm quite amazed how long this thread has gone on for. Does it not say buying/selling things for real money is not permissable, and does it not say that the punishment is an account ban? Why is this so up for discussion? As someone said before, YOU clicked "I agree".
And you say you're totally going after the sellers....sellers are driven by buyers.... at least the sellers are just sorry chumps who are trying to make a buck, rather than UNFAIRLY BUY their way into the game....and you're trying to tell me that the sellers piss you off more? how about the people who would rather spend $$ to beat you in the game, than play the game like everyone else does and earn it??

Have you tried emailing their support? Best of luck man, it sounds like it must have been some sort of mistake.

Frankly, they both need to just go away.
It's like a chicken/egg thing with these losers.. on the one hand it took a big enough loser to think for the first time "hmmm.. I bet there's some loser out there who would bid real money on an e-bay auction for in-game items"
On the other hand, for that scheme to have worked there also had to be a big enough loser out there thinking "hmmmm... I'm too much of a loser to earn these items through normal gameplay.. If only someone was willing to sell them to me like on e-bay, LOLLz0RRzz!!!11"
The fact that either of these two exemplary idiots took the time to actually get onto e-bay and investigate their ideas is simply pathetic.
If ANet is taking a hard-line against this sort of foolishness, then I have to say I'm glad. So far, I'm not seeing them banning anyone for playing the game as it was meant to be played, at least

I can't help but think of some of the examples you are all giving here and I think you are all missing the important comparitive example. Prostitution!
Let's face it, You're trying to progress using the means of an illicit act. Which can be a criminal offence depending on the circumstances. When You clicked the "I agree" you agreed that using gains of an illicit act could result in your account being deleted or frozen. So, Like Prostitution being illegal in the real world, you turned to a cyber Hooker for your fix. They provided you with what you needed, and you were caught. Insstead of jail time or being deleted as the case would be, You got the cyber version of an STD, having to start all over again...
Foamy said it best.. Free your Mind!

It's funny the way things like this come into play...there will never be an end to it. Kind like real life eh? seems everyone has a solution...

Sorry, you deserve to get banned.

Macievelli, please email support. Although employees and devs of ANet do read fansite forums, you will not help your case except by communication with support. Selling and buying in game items with real life money, as stated many times in this thread, is not allowed by the EULA, and ArenaNet will do what they see fit to discourage such behavior.
As for whether or not it's right or appropriate to punish the buyer -- please keep in mind that in order to sell something, there has to be a demand. If people are less inclined to buy game items for real life money, the demand dwindles, and the sellers starve. It's oversimplified, and naive, to think that just by punishing the sellers, the problem might be rectified.
Also, ANet has released a statement on this issue today:

I'm sorry for your loss, Macievelli, but at this point, support is your best hope. Please email them, if you haven't already. To everyone else, please also remember to stay away from downloading malicious programs that might promise huge gains, but actually contain keyloggers, etc.
